Ah, but no shock there. Bush has the Court that will allow him to ride rough-shod over the Constitution. We need the Democrats in power, and then for the demise of one of the conservative five (Scalia, Alito, Roberts, Thomas and Kennedy). Then the SCotUS may finally step back into its role of interpreting the laws, rather than the current role of deferring to the Executive's interpretation of the law.
